1. Agreement to Terms

Welcome to MedCertMaster.com ("MedCertMaster," "we," "us," or "our"). These Terms of Use ("Terms") constitute a legally binding agreement between you and MedCertMaster governing your access to and use of our website, mobile application, and services (collectively, the "Services").

PLEASE READ THESE TERMS CAREFULLY, AS THEY CONTAIN AN ARBITRATION AGREEMENT AND CLASS ACTION WAIVER THAT AFFECTS YOUR RIGHTS REGARDING HOW TO RESOLVE DISPUTES.

2. Our Services: Nature and Purpose

  • Subscription Terms: If you purchase a subscription, it will automatically renew at the end of each billing cycle until you cancel. You can cancel your subscription at any time through your account settings. Cancellation stops the next renewal but does not trigger a refund for the current period.
  • Refund Policy: Due to the digital nature of our Content, we do not offer refunds except as required by law or at our sole discretion. Please review your purchase carefully.
  • Price Changes: We reserve the right to change our fees. Any price changes will be communicated to you in advance.

  • Limitation of Liability: To the fullest extent permitted by law, MedCertMaster, its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Services, even if advised of the possibility of such damages.
  • Cap on Liability: Our total liability to you for any claim arising out of or relating to these Terms or the Services shall not exceed the greater of the amount you paid to us in the past six months or one hundred dollars ($100).

8. Indemnification

You agree to defend, indemnify, and hold harmless MedCertMaster and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Services; (b) your violation of these Terms; or (c) your violation of any third-party right.

  • Informal Resolution: We aim to resolve disputes amicably. Please contact us first at legal@MedCertMaster.com with any concerns.
  • Arbitration Agreement: If informal resolution fails, any dispute shall be settled by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court.
  • Class Action Waiver: You and MedCertMaster agree that each may bring claims against the other only in your individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.

10. Termination

We may suspend or terminate your account and access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will cease immediately.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Services after the effective date constitutes acceptance of the new Terms.
